MyProfessional.ch is an online platform operated by Vertigo Motion GmbH (8055 Zürich, Switzerland) designed to connect homeowners and renters with independent professionals for home-related services.

These Platform Terms explain how the platform works and clarify the roles and responsibilities of all parties involved.

1. Role of MyProfessional.ch

MyProfessional.ch facilitates contact between users and independent professionals. Specifically, we:

List independent professionals and their services
Enable users to discover and contact professionals via WhatsApp, email, or contact form
Provide visibility and exposure to professionals
When a user submits a general service request (not directed at a specific professional), distribute that request to multiple matching professionals who may then contact the user directly

MyProfessional.ch is not a party to any agreement between users and professionals. Any contract for services is exclusively between the user and the professional they choose to work with.

2. Ranking and display of professionals

The order in which professionals appear on the platform is determined by an automated ranking system. This ranking is based on factors such as review scores, response patterns, and profile completeness.

The ranking does not constitute a recommendation, endorsement, or quality guarantee. MyProfessional.ch does not verify the qualifications, licenses, insurance status, or work quality of any professional listed on the platform.

3. Role of Professionals

Professionals listed on MyProfessional.ch are independent service providers. They:

Offer their services independently and under their own responsibility
Communicate directly with homeowners or renters
Set their own prices, availability, and conditions
Are solely responsible for the quality, safety, and legality of the services they provide
Declare that they hold valid business liability insurance (Betriebshaftpflichtversicherung) covering their professional activities and assume full responsibility for any damage caused during the execution of their work

Professionals do not work for MyProfessional.ch. Their inclusion on the platform does not imply an employment relationship, endorsement, or supervision by MyProfessional.ch.

4. Role of Users (Homeowners and Renters)

Users of the platform:

Select professionals at their own discretion
Communicate and agree on service details directly with the professional
Are responsible for evaluating professionals based on available information (profiles, reviews, direct communication) before confirming any service

MyProfessional.ch encourages users to clearly agree on scope, pricing, timing, and payment terms directly with the professional before any work begins.

5. Agreements, Payments, and Cancellations

All agreements, payments, cancellations, changes, and disputes are handled directly between the user and the professional.

MyProfessional.ch:

Does not process payments for services
Does not manage bookings or schedules
Does not handle cancellations, refunds, or disputes

Any contractual relationship exists solely between the user and the professional.

6. Limitation of Liabilit

To the maximum extent permitted by Swiss law (OR Art. 100), MyProfessional.ch’s liability is limited to cases of intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit) on the part of Vertigo Motion GmbH.

MyProfessional.ch is not liable for:

The quality, safety, legality, or outcome of services provided by professionals
Any damages, delays, losses, or disputes arising from services performed by professionals
Misrepresentations made by professionals or users
Any decision made by a user to engage a particular professional

Use of the platform is at your own discretion and risk. MyProfessional.ch’s role is limited to facilitating contact between independent parties.

7. Reviews

MyProfessional.ch displays reviews submitted by users about professionals. Reviews reflect the personal opinion of the reviewer and do not represent the views of MyProfessional.ch. We do not verify the accuracy of reviews. Reviews are published transparently and are visible to all platform users.

8. Applicable Law and Jurisdiction

These Platform Terms are governed by Swiss law. The exclusive place of jurisdiction is Zürich, Switzerland.

9. Changes to these Terms

We may update these Platform Terms from time to time. Any changes will be published on this page with an updated effective date.
